Argentine Citizenship by descent

Under the Argentine Citizenship Act, the children of native Argentine persons can apply for Argentine nationality in a Consular Office. This is so regardless of age or gender of the Argentine person or the interested person.

This right does not extend to parents, spouses, or any other family member of a native Argentine person.

Procedure before this Consulate: you must present the following documentation:

Minors under 18 years of age

  1. APOSTILLED certificate of live birth (*) along with an official translation if the language is other than Spanish, to be filed at the Consulate. This is the extended versions of the documents. Short versions will not be accepted.
  2. If the birth occurred in a country or state not belonging to the jurisdiction of this Consulate, the apostilled birth certificate must be registered in the Consulate corresponding to the birth location, which may slow down the process. However, this Consulate can do it on your behalf.
  3. Original or digitally signed birth certificate of the native Argentine father or mother (if both are native, either will suffice). The original will be returned once the process is completed.
  4. Both parents are required to bring DNI (ID), only to be replaced by a passport or Florida Driver´s License in case of nationals of third countries.
  5. Passport or valid id of the minor acquiring citizenship

 

Over 18 years of age

  1. Current identification document of the applicant (passport, driver's license) in which their name appears exactly as it appears on their birth certificate.
  2. If the birth occurred in a country or state not belonging to the jurisdiction of this Consulate, the apostilled birth certificate must be registered in the Consulate corresponding to the birth location, which may slow down the process. However, this Consulate can do it on your behalf.
  3. Original or digitally signed birth certificate of the native Argentine father or mother (if both are native, either will suffice). The original will be returned once the process is completed.
  4. Copy of DNI (Argentine ID) of Argentinean parents, especially the one giving citizenship, if available.

 

IMPORTANT: * In all cases, it is essential that the names appearing on the Birth Certificates match those on the identification documents and that there are no initials of any name. * Verify that the data matches the Argentine documentation. For example, if the Argentine mother presents their DNI with a name different from that on the birth certificate, because the mother's maiden name was removed, or abbreviations are included instead of middle names, this will prevent birth registration, as instructed by the Regulating Body in Argentina.

In these cases, the interested party must request an amendment to the local body that issued the document.

Once you have all the documents, please email the Consulate with the subject OPCION- [FULL NAME OF THE PERSON IN QUESTION] attaching all the documents in ONE PDF FILE.

Once the documentation has been reviewed and verified, an appointment will be assigned to hand ORIGINALS in person or via POSTAL SERVICE.

At the time of the first appointment (or via mail) one USPS Money Order for $40 will be included.  This fee applies to the REGISTRATION of the birth.

A new appointment will then be arranged for the OPCION, exclusively in person the minor and both parents where applicable, or only the interested person in case they are over 18. All must carry their valid ID as presented previously.

For this second appointment, the consular fee is $80 for the OPCION (or as advised depending on the length), and $15 for the ID (DNI). Additionally, for minors under 14, they can choose to apply for a passport for a fee of $165 at the same time. For persons over 18, they will necessarily have to wait for the DNI to arrive, and apply for a passport afterwards a the same cost.
